Civil Division

The Civil Unit performs the processing and serving of civil process, which is a duty of the Sheriff in his role as Executive and Ministerial Officer of the California Superior Court in Monterey County. These processes include small claims, real property levies, and bank levies. The unit is also responsible for processing evictions. All these services are provided throughout the entire county including locations inside the incorporated cities. In 2006 the Sheriff’s Civil unit processed a total of 7,444 services. These included 643 evictions, 3340 criminal subpoenas served and 1273 earnings withholding orders (attachments to paychecks for debts owed.)

For the Sheriff to serve your documents, we require that the service be mailed or hand-delivered with both of the following:
1.
original (not faxed) Service Instruction Form signed by the plaintiff/litigant or their attorney. Levy Service Instruction form, if needed.
